This is yet another example of an old medium trying to fight technology. Technology goes one way: it advances. Whenever an organization attempts to force its business model onto people via courts or regulatory schemes, it is fighting a futile and, ultimately, losing battle. Recall how film studios fought the VCR and, today, are fighting peer to peer file sharing, etc. People are going to do what they are going to do. Rather than have this sort of discussion with its lawyers, AP would do better in the long run to have a brainstorming session with focus groups of targeted demographics, marketing experts, and college students to find out what the economic demand (demand, not "want" "desire" "need" etc.) for news products is and then set about meeting that demand. That's the only way to make money. This current "plan" seeks to compel demand; hardly a recipe for success or sustainability over the long haul.

"So I guess the first question to ask is will Neiman Journalism Lab and/or Zach Steward be sued for publishing a confidential AP document? Or was permission granted?"

Mere readers aren't supposed to ask such impertinent questions. After all, Nieman is pioneering the future of journalism, which will be more transparent and interactive than the stodgy "just trust us" attitude of traditional media outlets. That old media has rightly lost the public's trust for such dodgy tactics as using anonymous sources, documents obtained under deliberately shadowy conditions, and playing softball with influential organizations.

I'm so glad Nieman is changing all that.

May as well get the litigation started, doncha think? The Associated Press, one of the most revered brands in the history of Journalism vs. The Nieman Foundation, one of the most revered J-schools in the world.

I recall the famous saying of John Gilmore: "The Internet sees censorship as system damage and routes around it."

What's this going to devolve into? The RIAA-AP?

Good luck with that.
